好律师网 http://www.haolawyer.com/ 中华人民共和国统计法 (一九八三年十二月八日第六届全国人民代表大会常务委员会第三次会 议通过) 目 录 第一章 总 则 第二章 统计调查计划和统计制度 第三章 统计资料的管理和公布 第四章 统计机构和统计人员 第五章 法律责任 第六章 附 则 第一章 总 则 第一条 为了有效地、科学地组织统计工作,保障统计资料的准确性 和及时性,发挥统计在了解国情国力、指导国民经济和社会发展中的重要 作用,促进社会主义现代化建设事业的顺利发展,特制定本法。 第二条 统计的基本任务是对国民经济和社会发展情况进行统计调 查、统计分析,提供统计资料,实行统计监督。 第三条 国家机关、社会团体、企业事业组织和个体工商 户,以及 在中国境内的外资、中外合资和中外合作经营的企业事业组织,必须依照 本法和国家规定,提供统计资料,不得虚报、瞒报、拒报、迟报,不得伪 造、篡改。 基层群众性自治组织和公民有义务如实提供国家统计调查所需要的情 况。 第四条 国家建立集中统一的统计系统,实行统一领导、分级负责的 统计管理体制。 国务院设立国家统计局,负责组织领导和协调全国统计工作。 各级人民政府、各部门和企业事业组织,根据统计任务的需要。设置 统计机构和统计人员。 第五条 国家有计划地加强统计计算和数据传输技术的现代化建设。 第六条 各地方、各部门、各单位的领导人领导和监督统计机构、统 计人员和其他有关人员执行本法和统计制度。 各地方、各部门、各单位的领导人对统计机构和统计人员依照本法和 统计制度提供的统计资料,不得修改;如果发现数据计算或者来源有错误, 应当责成统计机构、统计人员和有关人员核实订正。 第七条 统计机构和统计人员实行工作责任制,依照本法和统计制度 的规定,如实提供统计资料,准确及时完成统计工作任务,保守国家机密。 统计机构和统计人员依照本法规定独立行使统计调查、统计报告、统 计监督的职权,不受侵犯。 第二章 统计调查计划和统计制度 第八条 统计调查必须按照经过批准的计划进行。统计调查计划按照 统计调查项目编制。 国家统计调查项目,由国家统计局拟订,或者由国家统计局和国务院 有关部门共同拟订,报国务院审批。 部门统计调查项目,调查对象属于本部门管辖系统内的,由该部门拟 订,报国家统计局或者同级地方人民政府统计机构备案;调查对象超出本 部门管辖系统的,由该部门拟订,报国家统计局或者同级地方人民政府统 计机构审批,其中重要的,报国务院或者同级地方人民政府审批。 地方统计调查项目,由县级以上地方各级人民政府统计机构拟订,或 者由县级以上地方各级人民政府统计机构和有关部门共同拟订,报同级地 方人民政府审批。 发生重大灾情或者其他不可预料的情况,县级以上地方各级人民政府 可以决定在原定计划以外进行临时性调查。 制定统计调查项目计划,必须同时制定相应的统计调查表,报国家统 计局或者同级地方人民政府统计机构审查或者备案。 国家统计调查、部门统计调查、地方统计调查必须明确分工,互相衔 接,不得重复。 第九条 重大的国情国力普查,需要动员各方面力量进行的,由国务 院和地方各级人民政府统一领导,组织统计机构和有关部门共同实施。 第十条 国家制定统一的统计标准,以保障统计调查中受用的指标涵 义、计算方法、分类目录、调查表式和统计编码等方面的标准化。 国家统计标准由国家统计局制定,或者由国家统计局和国家标准局共 同制定。 国务院各部门可以制定补充性的部门统计标准。部门统计标准不得与 国家统计标准相抵触。 第十一条 对违反本法和国家规定编制发布的统计调查表,有关单位 有权拒绝填报。 第三章 统计资料的管理和公布 第十二条 国家统计调查和地方统计调查范围内的统计资料,分别由 国家统计局、县级以上地方各级人民政府统计机构或者乡、镇统计员统一 管理。 部门统计调查范围内的统计资料,由主管部门的统计机构或者统计负 责人统一管理。 企业事业组织的统计资料,由企业事业组织的统计机构或者统计负责 人统一管理。 第十三条 国家统计局和省、自治区、直辖市的人民政府统计机构依 照国家规定,定期公布统计资料。 各地方、各部门、各单位公布统计资料,必须经本法第十二条规定的 统计机构或者统计负责人核定,并依照国家规定的程序报请审批。 第十四条 属于国家机密的统计资料,必须保密。属于私人、家庭的 单项调查资料,非经本人同意,不得泄露。 第四章 统计机构和统计人员 第十五条 县级以上地方各级人民政府设立独立的统计机构,乡、镇 人民政府设置专职或者兼职的统计员,负责组织领导和协调本行政区域内 的统计工作。 第十六条 县级以上地方各级人民政府统计机构和乡、镇统计员的管 理体制由国务院具体规定。 地方各级人民政府统计机构的人员编制由国家统一规定。 第十七条 国务院和地方各级人民政府的各部门,根据 统计任务的 需要设立统计机构,或者在有关机构中设置统计人员,并指定统计负责人。 这些统计机构和统计负责人在统计业务上并受国家统计局或者同级地方人 民政府统计机构的指导。 第十八条 企业事业组织根据统计任务的需要设立统计机构,或者在 有关机构中设置统计人员,并指定统计负责人。 企业事业组织执行国家统计调查或者地方统计调查任务,接受地方人 民政府统计机构的指导。 第十九条 国家统计局和地方各级人民政府统计机构的主要职责是: 一、制定统计调查计划,部署和检查全国或者本行政区域内的统计工 作; 二、组织国家统计调查、地方统计调查,搜集、整理、提供全国或者 本行政区域内的统计资料; 三、对国民经济和社会发展情况进行统计分析,实行统计监督; 四、管理和协调各部门制定的统计调查表和统计标准。 乡、镇统计员会同有关人员负责农村基层统计工作,完成国家统计调 查和地方统计调查任务。 第二十条 国务院和地方各级人民政府的各部门的统计机构或者统计 负责人的主要职责是: 一、组织、协调本部门各职能机构的统计工作,完成国家统计调查和 地方统计调查任务,制定和实施本部门的统计调查计划,搜集、整理、提 供统计资料; 二、对本部门和管辖系统内企业事业组织的计划执行情况,进行统计 分析,实行统计监督; 三、组织、协调本部门管辖系统内企业事业组织的统计工作,管理本 部门的统计调查表。 第二十一条 企业事业组织的统计机构或者统计负责人的主要职责 是: 一、组织、协调本单位的统计工作,完成国家统计调查、部门统计调 查和地方统计调查任务,搜集、整理、提供统计资料; 二、对本单位的计划执行情况进行统计分析,实行统计监督; 三、管理本单位的统计调查表,建立健全统计台帐制度,并会同有关 机构或者人员建立健全原始记录制度。 第二十二条 统计人员有权: 一、要求有关单位和人员依照国家规定,提供资料; 二、检查统计资料的准确性,要求改正不确实的统计资料; 三、揭发和检举统计调查工作中的违反国家法律和破坏国家计划的行 为。 第二十三条 统计人员应当具有执行统计任务所需要的专业知识。对 不具备专业知识的统计人员,应当组织专业学习。 第二十四条 国务院和地方各级人民政府的统计机构、各部门和企业 事业组织,应当依照国家规定,评定统计人员的技术职称,保障有技术职 称的统计人员的稳定性。 第五章 法律责任 第二十五条 有下列违法行为之一、情节较重的,可以对有关领导人 员或者直接责任人员给予行政处分: 一、虚报、瞒报统计资料的; 二、伪造、篡改统计资料的; 三、拒报或者屡次迟报统计资料的; 四、侵犯统计机构、统计人员行使本法规定的职权的; 五、违反本法规定,未经批准,自行编制发布统计调查表的; 六、违反本法规定,未经核定和批准,自行公布统计资料的; 七、违反本法有关保密规定的。 个体工商户有上列一、二、三项违法行为,情节严重的,可以经县级 人民政府批准,由工商行政管理部门给予暂停营业或者吊销营业执照的处 罚。当事人对处罚不服的,可以在接到处罚通知之日起十五日内向人民法 院起诉。 第二十六条 对违反本法构成犯罪的人员,由司法机关依法追究刑事 责任。 第六章 附 则 第二十七条 国家统计局根据本法制定实施细则,报国务院批准施行。 第二十八条 本法自一九八四年一月一日起施行。一九六三年国务院 发布的《统计工作试行条例》即行废止。(附英文) STATISTICS LAW OF THE PEOPLE`S REPUBLIC OF CHINA

Whole Document (法规全文) ISTICS LAW OF THE PEOPLE`S REPUBLIC OF CHINA pted at the Third Meeting of the Standing Committee of the h National People`s Congress, promulgated by Order No. 9 of the ident of the People`s Republic of China on December 8, 1983, and ctive as of January 1, 1984) ents ter I General Provisions ter II Plans for Statistical Investigations and the Statistical System ter III The Administration and Publication of Statistical Data ter IV Statistical Organs and Personnel ter V Legal Responsibility ter VI Supplementary Provisions Chapter I General Provisions cle 1 Law is formulated in order to organize statistical work in an ctive and scientific manner, to ensure accuracy and timeliness of istical data, to bring into play the important role of statistics in rehending the actual condition and strength of the country as well as uiding national economic and social development, and to promote the th progress of the socialist modernization. cle 2 fundamental task of statistical work is to make statistical stigations and analyses of national economic and social development, rovide statistical data and to exercise statistical supervision. cle 3 state organs, public organizations, enterprises, institutions, and -employed industrialists and businessmen, as well as all foreign-owned rprises and institutions, all Chinese-foreign equity joint ventures contractual joint ventures within the territory of China, shall, in rdance with the provisions of this Law and state provisions, provide istical data. They may not make false entries or conceal statistical , and they may not report statistical data belatedly or refuse to it statistical reports. Falsification and tampering of statistical shall be prohibited. nomous mass organizations at the grass-roots level and citizens have duty to provide truthful information needed for state statistical stigations. cle 4 state shall establish a centralized and unified statistical system, a satistical administrative structure under unified leadership and each level assuming responsibility for its own work. ate Statistical Bureau shall be established under the State Council to esponsible for organizing, directing and coordinating the statistical throughout the country. le`s governments at all levels and all departments, enterprises and itutions may, according to the needs of their statistical work, set up istical organs and staff them with statistical personnel. cle 5 state shall introduce in a planned way modern techniques of istical computing and data transmission. cle 6 ing members of all localities, departments and units shall direct and rvise statistical organs and personnel and other personnel concerned nforcing this Law and the rules governing statistical work. ing members of all localities, departments and units may not revise statistical data provided by statistical organs and personnel in rdance with the provisions of this Law and the rules governing istical work; if they find any error in data computation or in data ces, they shall instruct the statistical organs and personnel and r personnel concerned to make verification and corrections. cle 7 istical organs and personnel shall adopt the system of responsibility work. They shall, in accordance with the provisions of this Law and rules governing statistical work, truthfully provide statistical data, rately and promptly accomplish the task of statistical work and ect state secrets. ccordance with the provisions of this Law, statistical organs and onnel shall exercise, independently and free from interference, their tions and powers with regard to statistical investigations, istical reports and statistical supervision. Chapter II Plans for Statistical Investigations and the Statis- tical System cle 8 istical investigations shall be conducted in accordance with an oved plan. A statistical investigation plan shall be drawn up rding to statistical investigation items. State statistical stigation items shall be worked out by the State Statistical Bureau, y the State Statistical Bureau jointly with the relevant department or rtments of the State Council, and shall be submitted to the State cil for examination and approval. istical investigation items of a department shall be worked out, if units to be investigated lie within its jurisdiction, by the rtment itself and shall be reported to the State Statistical Bureau or statistical organ of a local people`s government at the same level the record; if the units to be investigated lie beyond its sdiction, the investigation items shall be worked out by the rtment and shall be reported to the State Statistical Bureau or to a istical organ of a local people`s government at the same level for ination and approval, but the important items shall be reported to the e Council or a local people`s government at the same level for ination and approval. l statistical investigation items shall be worked out by statistical ns of local people`s government at or above the county level, or by istical organs of local people`s governments at or above the county l jointly with the relevant department or departments, and shall all reported to local people`s governments at the same level for ination and approval. the event of serious natural calamities or other unforeseeable ations, local people`s governments at or above the county level may de to make interim investigations beyond the original plan. rawing up a plan for statistical investigation items, it is necessary raw up simultaneously appropriate statistical investigation forms, h shall be reported to the State Statistical Bureau or a statistical n of a local people`s government at the same level for examination or the record. e, departmental and local statistical investigations must be icitly divided in their functions. They should be made to dovetail each other and not overlap. cle 9 important general surveys of the condition and strength of the country e the joint efforts of different quarters are required, the State cil and local people`s governments at various levels shall exercise ied leadership and organize joint execution by statistical organs and r departments concerned. cle 10 state shall formulate unified statistical standards to ensure dardization of definitions of statistical items, computing methods, sification catalogues, investigation forms and statistical coding oyed in statistical investigations. The state statistical standards l be formulated by the State Statistical Bureau or by the State istical Bureau jointly with the State Bureau of Standards. The ous departments of the State Council may formulate supplementary rtmental statistical standards. Departmental statistical standards may conflict with the state statistical standards. cle 11 blishments concerned have the right to refuse to fill in statistical stigation forms drawn up and issued in violation of this Law and vant state provisions. Chapter III The Administration and Publication of Statistical Data cle 12 istical data within the scope of state and local statistical stigations shall be separately placed under the unified administration he State Statistical Bureau, the statistical organs of local people`s rnments at and above the county level or the statisticians of ships and towns. istical data within the scope of departmental statistical stigations shall be placed under the unified administration of istical organs or persons in charge of statistics of competent rtments. istical data of enterprises and institutions shall be placed under the ied administration of statistical organs or persons in charge of istics of the enterprises and institutions. cle 13 istical data shall, in accordance with the state provisions, be ished periodically by the State Statistical Bureau and statistical ns of the people`s governments of provinces, autonomous regions and cipalities directly under the Central Government. istical data to be published by various localities, departments and s shall be checked and ratified by the statistical organs or persons harge of statistics as prescribed in Article 12 of this Law, and shall submitted for examination and approval according to procedures ulated by the state. cle 14 istical data pertaining to state secrets must be kept confidential. le item investigation data concerning any private individual or her family shall not be divulged without the consent of the said on. Chapter IV Statistical Organs and Personnel cle 15 pendent statistical organs shall be established in local people`s rnments at and above the county level, and people`s governments of ships and towns shall be staffed with full-time or part-time isticians, who shall be responsible for organizing, guiding and dinating the statistical work in their respective administrative s. cle 16 administrative structure with regard to statistical organs of local le`s governments at and above the county level and statisticians of ships and towns shall be specifically prescribed by the State Council. sizes of the staff of statistical organs of local people`s governments arious levels shall be prescribed by the state in a unified way. cle 17 departments of the State Council and local people`s governments at ous levels shall, according to the needs of their statistical work, blish statistical organs, or staff relevant organs with statistical onnel, and appoint persons in charge of statistics. These statistical ns and persons in charge of statistics are, in statistical work, under direction of the State Statistical Bureau or statistical organs of l people`s governments at the corresponding level. cle 18 rprises and institutions shall, according to the needs of their istical work, establish statistical organs or staff relevant organs statistical personnel, and appoint persons in charge of statistics. rprises and institutions shall fulfil state or local statistical stigation tasks and accept the direction of statistical organs of l people`s governments. cle 19 main functions of the State Statistical Bureau and statistical organs ocal people`s governments at various levels are as follows: to draw up plans for statistical investigations and map out and ect statistical work throughout the country or in their respective nistrative areas; to organize state and local statistical investigations and to collect, ile and provide statistical data of the whole country or of their ective administrative areas; to make statistical analyses of national economic and social lopment and to exercise statistical supervision; and to administer and coordinate work concerning the statistical stigation forms and statistical standards worked out by the various rtments. Statisticians of townships and towns shall, together with onnel concerned, take charge of the statistical work in rural areas at grass-roots level and accomplish the tasks of state and local istical investigations. cle 20 main functions of statistical organs or persons in charge of istics of departments of the State Council and local people`s rnments at various levels are as follows: to organize and coordinate the statistical work of various functional ns of such departments, to execute the tasks of state and local istical investigations, to draw up and carry out statistical stigation plans of such departments and to collect, compile and ide statistical data; to make statistical analyses of and exercise statistical supervision the implementation of plans of such departments and of the rprises and institutions under their jurisdiction; and to organize and coordinate the statistical work of enterprises and itutions under the jurisdiction of such departments and handle istical investigation forms of such departments. cle 21 main functions of statistical organs and persons in charge of istics of enterprises and institutions are as follows: to organize and coordinate the statistical work of such units, to ute the tasks of state, departmental and local statistical stigations, and to collect, compile and provide statistical data; to make statistical analyses of and exercise statistical supervision the implementation of plans of such units; and to handle statistical investigation forms of such units, to establish improve statistical master-file systems and to establish and improve, tly with organs or persons concerned, original record systems. cle 22 istical personnel have the powers: to require units or persons concerned to provide data in accordance state provisions; to check the accuracy of statistical data and to ask for correction of rrect statistical data; and to expose and report any act done in statistical investigation work contravenes the laws of the state and disrupts the state plan. cle 23 istical personnel should possess the professional knowledge necessary carrying out statistical tasks. Professional studies should be nized for statistical personnel lacking professional knowledge. cle 24 istical organs of the State Council and of local people`s governments arious levels, various departments, enterprises and institutions l, in accordance with relevant state provisions, evaluate statistical onnel and confer on them appropriate professional titles in order to re a fixed number of statistical personnel holding professional es. Chapter V Legal Responsibility cle 25 nistrative sanctions may be imposed on leading members concerned or onnel bearing direct responsibility for any of the following unlawful tices when the circumstances are rather serious: making false entries in statistical data or concerning statistical ; falsifying or tampering with statistical data; refusing to submit statistical reports or repeated late reporting of istical data; infringing upon the functions and powers exercised, as stipulated in Law, by statistical organs or personnel; drawing up and distributing by themselves, without authorization and iolation of the provisions of this Law, statistical investigation s; publishing by themselves, in violation of the provisions of this Law, rified and unapproved statistical data; or violating the provisions of this Law for the protection of secrets. self-employed industrialist or businessman who commits any one of the wful practices mentioned in (1), (2) and (3) above may, if the umstances are serious, and with the approval of a people`s government r above the county level, be punished with suspension of business ations or revocation of his business licence by an administrative rtment for industry and commerce. If the party concerned does not e with the decision, it may file suit in a people`s court within 15 from the date of receiving the notification of punishment. cle 26 ne whose contravention of this Law constitutes a criminal offence l be investigated for his criminal liability by judicial authorities ccordance with the law. Chapter VI Supplementary Provisions cle 27 State Statistical Bureau shall, in accordance with this Law, formulate s for its implementation and submit them to the State Council for oval before they are put into effect. cle 28 Law shall go into effect as of January 1, 1984. On that same day, the lations on Statistical Work for Trial Implementation promulgated by State Council in 1963 shall be invalidated.
